Background check companies should not report expunged criminal charges.

The Fair Credit Reporting Act requires that background checks be accurate, up to date, and complete. That means that a background check must tell the truth about your background and should not contain any mistakes. There have been several successful class actions against background check companies that improperly reported expunged charges. See Giddiens v. LexisNexis Risk Solutions, Inc., No. 12-cv-2624 (E.D. Pa.) (settled for at least $1,000 per class member, with the option to make a claim for more); Robinson v. General Info. Srvcs., Inc., No. 11-cv-7782 (E.D. Pa.) (settled for approximately $1,500 per class member).
