An employer can run a background check on you at any time, but only with your permission. Specifically, an employer (or potential employer) must disclosure to you, in writing, that it plans on running a background check, and must obtain your authorization to do so, in writing. These two documents – the disclosure form and the authorization form – can be combined into one, but no other extraneous information can be contained on that form. If employers include unrelated information on their disclosure form, they have violated the FCRA.
